Dr. Jones' Veterinary Secrets: Terms and Conditions

These terms and conditions of sale ("Agreement") are applicable to any order placed with and accepted by Dr. Jones' Veterinary Secrets: Dog and Cat Health Store (referred to herein as "Dr. Jones' Veterinary Secrets"). Purchaser shall be deemed to have full knowledge of the terms and conditions herein and such terms and conditions shall be binding if either the goods and services referred to herein are delivered to and accepted by Purchaser, or if Purchaser does not within five days from the date hereof deliver to Dr. Jones' Veterinary Secrets written objection to said terms and conditions or any part thereof.

1. GENERAL

In the event of any conflict or inconsistency between the terms and conditions of sale herein and the terms and conditions contained in Purchaser's order or in any other form issued by Purchaser, whether or not any such form has been acknowledged or accepted by Dr. Jones' Veterinary Secrets, Dr. Jones' Veterinary Secrets's terms and conditions herein shall prevail. No waiver, alteration or modification of these terms and conditions shall be binding upon Dr. Jones' Veterinary Secrets unless made in writing and signed by a duly authorized representative of Dr. Jones' Veterinary Secrets.

2. DISCLAIMER

PURCHASER EXPRESSLY UNDERSTANDS AND AGREES THAT:
THE CONTENT OF THIS SITE AND ANY MATERIAL DOWNLOADED FROM THIS SITE, INCLUDING ARTICLES, DIGITAL BOOKS OR REPORTS, IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL OR BEHAVIORAL ADVICE, DIAGNOSIS, OR TREATMENT. 3. AUTOSHIP PLANS AND SUBSCRIPTIONS

If Purchaser has selected a product or service that comes with an Autoship plan or Subscription, Purchaser authorizes Dr. Jones' Veterinary Secrets to charge the Purchaser's Credit Card or PayPal Account for the continuing or "standing" product or service order, on the schedule as selected when ordering, or as stated on the Product or Service description page, unless Purchaser has otherwise changed, suspended or canceled the agreement before the renewal date.
RIGHT TO CANCEL
Purchaser reserves the right to cancel an Autoship plan or Subscription at any time. Purchaser can cancel the Autoship plan or Subscription from within their account (under 'My Account > My Auto-ship Plans & Subscriptions'), or by contacting Dr. Jones' Veterinary Secrets via email or phone (see contact link below).
Purchaser may also request a change to an Autoship plan (i.e. change delivery schedules or renewal dates) any time by contacting Dr. Jones' Veterinary Secrets via email or phone.
If contacting Dr. Jones' Veterinary Secrets to cancel, Dr. Jones' Veterinary Secrets requires two (2) business days notice prior to any Autoship plan or Subscription renewal date, either by email or phone message, in order to cancel the Autoship plan or Subscription before it processes. If a request from Purchaser to cancel is not received two (2) business days prior to a renewal date, the plan will be canceled as of the next upcoming renewal date.

4. PAYMENT METHODS

Dr. Jones' Veterinary Secrets accepts VISA, MASTERCARD, or PAYPAL payments only.

5. PRODUCT PRICING

The prices payable by Purchaser for goods and services to be supplied by Dr. Jones' Veterinary Secrets under this Agreement will be specified in the applicable Order. Unless otherwise expressly stated in an Order, all prices exclude shipping and taxes. All prices are subject to correction for error. Dr. Jones' Veterinary Secrets reserves the right to change quoted prices prior to any Order for goods and services at any time without prior notice.
All prices are final as specific in the applicable Order.

6. TAXES

Prices do not include Goods & Services Tax, Provincial or Municipal sales, use, value-added or similar tax, in regions where applicable (see below). Accordingly, in addition to the price specified herein, the amount of any present or future sales, use, value-added or similar tax applicable to the sale of the goods hereunder to or the use of such goods by Purchaser shall be paid by Purchaser to the entire exoneration of Dr. Jones' Veterinary Secrets.

7. SHIPPING AND DELIVERY

SHIPPING: For any products that require shipping, orders will be processed and shipped out within 1-3 business days. Shipping Method is selected by Purchaser at time of Order.
DELIVERY: Delivery times are not guaranteed. Delivery schedules are approximate and are based on prevailing market conditions applicable respectively at the time of the Order and Dr. Jones' Veterinary Secrets's acceptance of Purchaser's order. Delivery shall also depend on the prompt receipt by Dr. Jones' Veterinary Secrets of the necessary information to allow maintenance of the manufacturer's engineering and manufacturing schedules. Dr. Jones' Veterinary Secrets may extend delivery schedules or may, at its option, cancel Purchaser's order in full or in part without liability other than to return any payment which is unearned by reason of the cancellation.

8. RETURN AND REFUND POLICIES

No goods may be returned to Dr. Jones' Veterinary Secrets without Dr. Jones' Veterinary Secrets's prior written permission. Dr. Jones' Veterinary Secrets reserves the right to decline all returns or to accept them subject to a 15% handling/restocking charge. Even after Dr. Jones' Veterinary Secrets has authorized the return of goods for credit, Dr. Jones' Veterinary Secrets reserves the right to adjust the amount of any credit given to Purchaser on return of the goods based on the conditions of the goods on arrival in Dr. Jones' Veterinary Secrets's warehouse. Credit for returned goods will be issued to Purchaser only where such goods are returned by Purchaser and not by any subsequent owner of the goods.

Return and Refunds for Product/Service Types:

Refunds on Digital Products

For a refund on any digital products (including downloadable courses, e-Books, videos, membership subscriptions), Purchaser must provide name, email address and Order ID, and must agree to and confirm deletion of the digital product ordered, prior to the refund. All digital products may be refunded within 30 days after the date of purchase.

Refunds on Supplements

"Trial" Products: Purchaser may receive a refund on a Trial jar order within 60 days of placing the order. The jar can be opened, and Dr. Jones' Veterinary Secrets will provide a refund of 100% of the cost of the purchase, including any shipping fees and taxes.

Non-Trial (Regular) supplement orders: jar must be unopened and the plastic seal must be intact in order to qualify for a refund. Dr. Jones' Veterinary Secrets will accept refunds on all unopened jars of supplements up to 60 days after the Order has been placed.
Dr. Jones' Veterinary Secrets will issue a refund for the cost of the jar only. Dr. Jones' Veterinary Secrets will not refund any shipping fees paid. In addition, a restocking fee of 15% of the cost of the item will be deducted from any refunded amount.

Other Physical Products (DVDs, books, courses)

Dr. Jones' Veterinary Secrets will accept returns of other physical products up to 60 days after the date of the Order.
Dr. Jones' Veterinary Secrets will issue a refund for the cost of the item only. Dr. Jones' Veterinary Secrets will not refund any shipping fees paid. In addition, a restocking fee of 15% of the cost of the item will be deducted from any refunded amount.

9. TERMS OF ORDER AND PAYMENT

All Orders are not binding upon Dr. Jones' Veterinary Secrets until Payment has been received in full. Payment for product(s) ordered is due in full prior to shipment.

10. ORDER CHANGES AND CANCELLATION

Orders accepted by Dr. Jones' Veterinary Secrets are not subject to changes or cancellation by Purchaser, except with Dr. Jones' Veterinary Secrets's written consent. In such cases where Dr. Jones' Veterinary Secrets authorizes changes or cancellation, Dr. Jones' Veterinary Secrets reserves the right to charge Purchaser with reasonable costs based upon expenses already incurred and commitments made by Dr. Jones' Veterinary Secrets, including, without limitation, any labour done, material purchased and also including Supplier's usual overhead and reasonable profit and cancellation charges from Dr. Jones' Veterinary Secrets's suppliers.

11. FORCE MAJEURE

Dr. Jones' Veterinary Secrets shall not be responsible or liable for any loss or damage incurred by Purchaser herein resulting from causes beyond the reasonable control of Dr. Jones' Veterinary Secrets including, but without limitation, acts of God, war, invasion, insurrection, riot, the order of any civil or military authority, fire, flood, weather, acts of the elements, delays in transportation, unavailability of equipment or materials, breakdown, sabotage, lock-outs, strikes or labour disputes, faulty castings or forgings, or the failure of Dr. Jones' Veterinary Secrets's suppliers to meet their delivery promises. The acceptance of delivery of the equipment by Purchaser shall constitute a waiver of all claims for loss or damage due to any delay whatsoever.

12. SHIPMENT/DAMAGES OR SHORTAGES IN TRANSPORT/RISK

Except for obligations stated under "Warranty" herein, Dr. Jones' Veterinary Secrets's responsibility for goods ceases upon delivery to the carrier. In the event of loss or damage during shipment, Purchaser's claim shall be against the carrier only. Dr. Jones' Veterinary Secrets will, however, give Purchaser any reasonable assistance to secure adjustment of Purchaser's claim against the carrier provided immediate notice of such claim is given by Purchaser to Dr. Jones' Veterinary Secrets. Claims for shortages must be made in writing within ten (10) days after receipt of goods by Purchaser. If Dr. Jones' Veterinary Secrets does not receive written notification of such shortages within such ten (10) days, it shall be conclusively presumed that the goods were delivered in their entirety. Unless agreed upon otherwise in writing, Dr. Jones' Veterinary Secrets reserves the right to make partial shipments and to submit invoices for partial shipments.

13. TITLE

Title to the goods or any part thereof shall not pass from Dr. Jones' Veterinary Secrets to Purchaser until all payments have been made as stated in the Order. Title to the product(s) -- excepting digital downloads -- and risk of loss passes to the Purchaser upon delivery to the carrier. The Purchaser takes title to the product upon Dr. Jones' Veterinary Secrets's delivery of the product to the carrier.

14. LIABILITY

IN ALL CIRCUMSTANCES DR. JONES' Veterinary Secrets'S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. DR. JONES' Veterinary Secrets SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. DR. JONES' VETERINARY SECRETS SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE PURCHASER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, SPECIAL DAMAGES OR EXEMPLARY DAMAGES, WHETHER OR NOT DR. JONES' Veterinary Secrets HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

15. WARRANTY

DR. JONES' Veterinary Secrets'S WEBSITE AND ALL PRODUCTS SOLD WITHIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, FOUR PAWS ONLINE LTD. AND DR. JONES' Veterinary Secrets AND ITS AFFILIATES AND SUBSIDIARIES (COLLECTIVELY, "AFFILIATES") EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, FOUR PAWS ONLINE LTD. AND DR. JONES' Veterinary Secrets AND ITS AFFILIATES MAKE NO WARRANTY, EXPRESS OR IMPLIED, THAT THE PRODUCTS OBTAINED ON OR THROUGH THE WEBSITE WILL MEET YOUR REQUIREMENTS; NOR DOES FOUR PAWS ONLINE LTD. 16. THE AGREEMENT

An acceptance and official confirmation of Purchaser's order by Dr. Jones' Veterinary Secrets shall constitute the complete agreement, subject to the terms and conditions of sale herein set forth, and shall supersede all previous quotations, orders or agreements. The law of the Province of British Columbia, Canada shall govern the validity, interpretation and enforcement of these terms and conditions of sale and of any contract of which these terms and conditions are a part.

ADDENDUM TO GENERAL TERMS AND CONDITIONS OF SALE

2A. DISCLAIMER

NO MEDICAL CLAIMS ARE BEING MADE FOR "DR. JONES' ULTIMATE CANINE HEALTH FORMULA", "DR. JONES' ULTIMATE CANINE ADVANCED HEALTH FORMULA", OR "DR. JONES' ULTIMATE FELINE HEALTH FORMULA" ("THE SUPPLEMENTS") ON DR. JONES' Veterinary Secrets. THE INFORMATION PROVIDED HERE IS BASED ON VALID SCIENTIFIC RESEARCH IN ADDITION TO EXPERT OPINIONS OF PROFESSIONALS THAT ARE INVOLVED IN THE DEVELOPMENT AND APPLICATION OF THE SUPPLEMENTS.
